A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since his release after wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her order.

The case originates in a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an mistake. Following his repatriation to the United States to face human smuggling charges, he was held in immigration detention.

In her order, the court pointed out that the authorities lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
